Terms of Service
1. Agreement to These Terms
These Terms of Service ("Terms") govern your use of Hyve Pilates LLC's ("Hyve Pilates," "we," "us," or "our") studio at 57 Hamburg Tpke, Suite C, Riverdale, NJ 07457, our website at hyvepilates.com, and our booking platform (together, our "Services"). By creating an account, booking a class, making a purchase, or entering the studio, you agree to these Terms, our Privacy Policy, and any waiver or membership agreement you sign with us. If you do not agree, do not use our Services.
2. Eligibility and Waiver
Clients must be at least 13 years old to take class. Clients ages 13 to 17 must have a parent or legal guardian complete their account and sign the liability waiver on their behalf. Every client must have a signed waiver on file before attending any class. You are responsible for keeping your account information accurate and for all activity under your account.
3. Health and Assumption of Risk
Pilates, barre, and related exercise involve physical exertion and carry a risk of injury. You should consult a physician before starting any exercise program, particularly if you are pregnant, recovering from an injury, or managing a medical condition. You are responsible for telling your instructor about any injury, condition, or limitation before class, and for working within your own abilities. By participating, you voluntarily accept the risks involved, as further described in the waiver you signed.
4. Booking and Pricing
All classes must be booked in advance through the Momence app or our website. Current prices, class packs, memberships, intro offers, and expiration periods are listed on our pricing page and at checkout, and may change at any time. Changes do not affect purchases already completed. All online and in-app transactions include a processing fee set by our booking platform.
Intro offers are for first-time clients only, are limited to one per person, and must be used within the redemption period stated at purchase.
5. Class Packs
Class packs expire according to the period stated at the time of purchase. Unused classes are forfeited at expiration and will not be extended, transferred, or refunded. Class packs are for the purchaser only and may not be shared.
6. Memberships
All memberships are billed on a 28-day cycle, not monthly. Your first cycle begins on the day you join, with full access from day one and no prorated first cycle.
All memberships require a minimum commitment of 3 billing cycles. After the commitment is met, your membership renews automatically every 28 days until canceled. By purchasing a membership, you authorize Hyve Pilates to charge your payment method on file each cycle.
Membership cancellations must be submitted by you through the Momence app, in accordance with your membership agreement. We cannot accept membership cancellations by text, email, direct message, or in person. You remain responsible for all charges through the end of your commitment and any cycle that has already begun.
If a recurring payment fails, your booking access may be suspended until the balance is paid.
7. Class Cancellations and No-Shows
Classes must be canceled at least 2 hours before the scheduled start time. Cancellations must be made through the Momence app. We cannot accept class cancellations by text, email, or direct message.
Late cancellations and no-shows are handled as follows:
- Members are charged a $15 fee.
- Non-members forfeit the class from their pack or purchase.
8. Late Arrivals
Please arrive on time. Clients who arrive more than 5 minutes after class begins may have their spot released to a waitlisted client, and clients arriving more than 10 minutes late will not be admitted for their safety. Late arrivals who are not admitted are treated as a no-show.
9. Refunds
All sales are final. Hyve Pilates does not issue refunds, credits, or exchanges for memberships, class packs, intro offers, private sessions, events, merchandise, gift cards, or unused classes, except where a refund is required by New Jersey law.
10. Gift Cards
Gift cards do not expire. They are not refundable, cannot be redeemed for cash, and cannot be replaced if lost or stolen.
11. Studio Conduct
We expect every client to treat instructors, staff, and other clients with respect, follow instructor directions, and use equipment only as instructed. We may refuse service, remove a client from class, or suspend or terminate an account for unsafe, disruptive, or disrespectful behavior, or for violating these Terms. No refund will be issued in those cases.
Hyve Pilates is not responsible for lost, stolen, or damaged personal belongings. You are responsible for any damage you cause to studio equipment or property beyond normal use.
12. Photography, Video, and Audio Recording
By entering the studio, you agree that you may be photographed or filmed during classes and events, and that those images and recordings may be used in our website, social media, advertising, and other promotional material without compensation. The studio is also monitored by audio and video recording at all times, and our team reviews these recordings regularly. Do not say or do anything in the studio that you would not want recorded or heard by our team. Details are in our Privacy Policy.
13. Schedule Changes
We may change the class schedule, substitute instructors, or cancel classes at any time, including for low enrollment, weather, or emergencies. If we cancel a class you booked, the class will be returned to your account. Instructor substitutions are not grounds for a refund or credit.
14. Website Content and AI Tools
All content on our website, app listings, and social media, including text, photos, video, logos, and graphics, belongs to Hyve Pilates or its licensors and may not be copied or used without our written permission. Some content may be created or edited with the help of artificial intelligence tools. Website and social media content is for general information only and is not medical or professional advice.
15. Limitation of Liability
To the fullest extent permitted by law, Hyve Pilates, its owners, staff, and instructors are not liable for any indirect, incidental, or consequential damages arising from your use of our Services. Our total liability for any claim related to our Services will not exceed the amount you paid us in the 3 months before the claim arose. Nothing in these Terms limits liability that cannot be limited under New Jersey law.
16. Governing Law
These Terms are governed by the laws of the State of New Jersey. Any dispute will be resolved in the state or federal courts located in Morris County, New Jersey.
17. Changes to These Terms
We may update these Terms at any time. The effective date at the top reflects the latest version. Continued use of our Services after an update means you accept the revised Terms.
